1. Conditions for Sponsorship to Canada

To be able to sponsor your spouse or partner, you need to meet some basic requirements:

A. Guarantor

  • Age: You must be 18 years or older.
  • Canadian Status: Must be a Canadian citizen, permanent resident, or registered Indian under the Canadian Indian Act.
  • Foreign Nationalities: If you live outside Canada, you must demonstrate your intention to return when your partner becomes a permanent resident.
  • Permanent Residents: You cannot sponsor if you live outside Canada.
  • Financial Stability: Must not receive social assistance (except disability benefits) and must be able to meet your partner’s basic needs.

B. Sponsored person:

  • Marital partner: Must be at least 18 years old, regardless of gender, have been in a relationship with you for at least one year, live outside Canada, and cannot cohabit or marry you due to legal or immigration barriers.
  • Spouse: Must be legally married to you, at least 18 years old, and can be of the same or opposite sex.
  • In-relationship partner: Must be at least 18 years old, of either sex, not legally married to you, and have lived with you in a marital relationship for at least 12 consecutive months. Evidence includes joint property, joint leases, or utility bills.
  • Children or parents

C. Commitment to each other

Both you and your sponsor must agree to a sponsorship commitment, which means:

  • Guarantor commitment: You commit to meeting your partner’s basic needs.
  • Sponsored person commitment: The sponsored person agrees to make efforts to support themselves and any family members they bring with them.

D. Real relationship

Must demonstrate that the relationship is genuine and not just for immigration purposes. The sponsored person and family must pass background, security, and medical checks.

E. Financial capability

The sponsor must have the financial ability to support the sponsored person initially.

  • Sponsoring a partner means that you must support them financially for at least three years after they become a permanent resident, including repaying any public benefits they may receive.
  • In most cases, there is no minimum income requirement to sponsor a spouse, common-law partner, or civil partner.

However, if your partner has dependent children who also have children of their own, you will need to meet certain income thresholds.

F. Right Class Application

  • Family Class: If your partner lives outside of Canada, or if they are your conjugal partner, you will need to apply under the Family Class. These applications are processed outside of Canada.
  • Spouse or Common-Law Partner in Canada: If your spouse or common-law partner is living with you in Canada, you may apply under this class. This allows your partner to apply for an Open Work Permit while their application is being processed.

2. Canada Sponsorship Procedure

The sponsorship process usually includes the following steps:

  • Preparing documents: Including documents proving the relationship (such as photos, joint bills, letters…), personal documents of both parties.
  • Submitting the application: The sponsorship application is usually submitted through Canadian immigration agencies, with a processing fee.
  • Interview: There may be an interview to verify the information in the application.
  • Approval: After review, the agency will notify the result. If approved, the sponsored person will receive a visa to immigrate to Canada.

  • Easier immigration procedures: Compared to other forms, spousal sponsorship often has a simpler and faster process.

4. Considerations

  • Proof of relationship: It is important to prepare the supporting documents carefully to avoid difficulties during the approval process.
  • Waiting time: The processing time of the application can last from a few months to more than a year, depending on each specific case.
